Town of Fairfield Noise Ordinance

The town of Fairfield has a noise ordinance that prohibits excessive noise during both daytime and nighttime hours, in compliance with state requirements.

Daytime hours are defined as:

  • Monday through Friday: 7:00am to 10:00pm
  • Saturday, Sunday, state or national holidays: 8am to 10:00pm

Nighttime hours are defined as:

  • Sunday, Monday, Tuesday, Wednesday, Thursday: 10:00pm at night to 7:00am the following morning
  • Fridays, Saturdays, and nights preceding state or national holidays: 10:00pm at night to 8:00am the following morning

Noise Level Standards

When determining whether noise is considered to be excessive, different standards apply depending on property use and time of day.

Per town ordinance, it shall be unlawful for any person to emit or cause to be emitted any noise from such person's property beyond the boundaries of his property lines in excess of the noise levels set forth below:

The "Plainly Audible Noise" standard allows a responding officer to issue a violation without taking a decibel reading when responding to noises produced by a "Sound Production Device", which is defined as any device whose primary function is the production of sound and is electronically amplified (loudspeakers, vehicle stereos, public address systems, sound-amplifying equipment, etc.).

The ordinance also contains certain specifically prohibited and excepted noise emissions which can be found in the full text of the code.

The ordinance is enforced by the Fairfield Police Department and penalties include warnings, $100 for the first citation, and $250 for subsequent citations.
