S. PINE CREEK PARTY RENTAL RULES

  1. Lessee is required to sign a lease agreement. Each application will be reviewed by the Parks & Recreation Department for approval or denial at the Department’s discretion. All fees must be fulfilled two weeks prior to function date and are payable by the Lessee stated on application.  If different, the Non-Resident rate will be charged.

  2. Lessee must be at least 21 years of age.

  3. Facility is useable by bona fide families, neighborhood groups, Town sponsored functions, and various types of meetings.

  4. Usage must be strictly limited to activities listed on the application. The determination of the legitimacy of this usage will be at the discretion of the designated Town Official.

  5. Lease is limited to the multi-purpose room and game room (*pool table use–11 years and older only).

  6. NO alcoholic beverages are permitted on the premises.

  7. Cancellations made less than 30 days from the event date will result in forfeiture of the entire deposit. A date change is considered a cancellation. Deposits will not be refunded should a canceled date be rented to someone else. Should the Lessor have to close the building due to inclement weather or other circumstances, the Lessee will have the option to rebook or be refunded.  On the date of the event, should the Lessee ask to rebook the event, the Lessor will make every attempt to do so. No refunds will be given.

  8. Transfer of this permit to a second party or sublease is not permissible (lease is not to caterer).

  9. Rates may be adjusted according to Parks & Recreation Commission action.

  10. Lessee must provide adequate supervision to insure proper conduct and safety.

  11. The Town reserves the right to cancel function for not abiding by regulations, misconduct or any other action detrimental to participants or Town representatives.

  12. Lessee agrees to furnish any other information requested by Town.

  13. Damage Bond information will be taken 2 weeks prior to the function. The Lessee will provide the account information of a current Credit Card which will be kept on file and will be charged if the Lessee has fabricated any part of this lease, the function does not stop at designated time or there is any property damage. Lessee is responsible for the full cost of any repairs or replacements. Lessee will be contacted prior to any fees being charged.

  14. The Lessee hereby accepts the premises in the condition in which they are at the beginning of this lease and agrees to maintain said premises in the same condition, order and repair in which they are at the commencement of said term excepting reasonable wear and tear arising from the use thereof under this agreement, and the Lessee shall be liable to the Town and shall forever hold harmless the Town from any and all such damage or loss occasioned to the premises or any of the Town’s properties caused by the acts or negligence of the Lessee or any person or persons in the employ or under the control of the Lessee.

  15. The Lessee assumes all risk in the operation of this permit and shall be solely responsible and answerable for all damages, accidents and injuries to persons and to personal property and hereby covenants and agrees to indemnify and keep harmless the Town and their officers and employees from any and all claims, suits, losses, damage or injury to person or property of any kind and nature whether direct or indirect arising out of the operation of this permit or the carelessness, negligence or improper conduct of the Lessee or any servant, agent or employee.  I specifically further release, absolve, indemnify and waive any claims against the Town of Fairfield, the Fairfield Parks & Recreation Department, their organizers, sponsors and any supervisors appointed by them for liability for their negligence.  It is expressly understood and agreed that no real or personal property is leased to the Lessee, that he is a Lessee and not a Lessor, that the Lessee’s right to occupy the premises and operate the permit hereby granted shall continue only as long as the Lessee shall comply strictly and promptly with each and all of the undertakings, provisions, covenants, agreements, stipulations and conditions of intended use herein contained. The Lessee agrees not to represent himself as an agent or associate of the Town of Fairfield, or the Parks & Recreation Department.  The Lessee shall supply this service, and no part of said service is to be sublet, assigned, transferred, converted or otherwise disposed of to any other company, corporation or person.  The Lessee shall not carry on, within or upon said permitted space, any other operation herein described.  The lease granted shall continue only so long as Lessee shall comply strictly and promptly with each and all of the undertakings, provisions, covenants, agreements, stipulations and conditions herein contained.

  16. The Lessee shall indemnify and save the Town harmless from any and all claims, liability, losses and causes of actions that may    arise out of the operation of the Lessee’s function under the lease agreement.  The Lessee shall pay all claims and losses of any nature whatsoever in connection therewith, and shall defend all service in the name of the Town when applicable, and shall pay all costs and judgments which may issue thereon. 

  17. It is expressly understood and agreed that the Lessee’s operation shall not interfere in any manner with the Public’s use of the facility or maintenance or to infringe upon the normal method of operation or any other parties who are authorized to conduct business in the area.  The Lessee agrees that a determination by the Director of Parks & Recreation or Complex Supervisor (or appropriate designate) will be accepted as final in evaluating activities which infringe on the rights of others and that he will fully comply with any decisions in this matter.

  18. If determined that any of the previous regulations are not applicable to a particular function, it will be at the discretion of the responsible Town official to waive said regulations.

  19. Capacities 150 maximum.  Number of participants expected must be stated in the contract and adhered to. These capacities are NOT to be exceeded under ANY circumstances, under penalty of law.

  20. Parking: All vehicles are to park in the adjacent lot. 

  21. Tables and chairs are provided by Lessor for set up by Lessee. NO furniture of any type may be brought in. Lessee must provide all paper products, table covering, glassware, etc.  Minimum decorating and set up may be done by Lessee. The use of confetti is prohibited. Decorations must be removed immediately after function.  TAPE ONLY (no nails, staples, etc.)

  22. An attendant will be provided by Lessor. The attendants’ responsibilities include opening the building on-time, assisting in the set-up of tables and chairs, overseeing the function during its operation and, after the party, the break-down and proper storage of the tables and chairs. The lessor is responsible for removing their tablecloths and putting the garbage in the proper bins.   The attendant is responsible for securing the building after the clean-up of the function.

  23. The attendant is an on-site representative of the Town of Fairfield and is responsible for the proper adherence to the Town’s rules and regulations governing this site. Any requests he/she makes to the Lessee must be abided or possible additional fees and/or forfeiture of the security deposit may occur. Failure to respond to a legitimate request promptly can also lead to the calling of the Police and immediate termination of the party.

  24. Lessee may not erect any tents or canopies.

  25. Bounce Houses are not permitted to be brought in by Lessee.

  26. Helium Tanks may be used.

  27. Sound must be kept at a reasonable level and the source of music must be confined to the interior of building.

  28. The facility is non-smoking, including the entrance and walkway area.

  29. Additional charges may be levied if any extra equipment, attendants or maintenance services are required.

  30. Food may be catered or provided by Lessee. All kitchen equipment (sinks, microwave, refrigerator, etc.) must be cleaned by the lessee/caterer.

  31. All equipment must be removed from the premises immediately after the event.

  32. The Town of Fairfield will not be held responsible for any lost or damaged goods.

  33. Recycling is mandatory and must be consistent with the Town of Fairfield’s policy.  The Lessee will be liable for any fines levied by the Town as well as subject to loss of Damage Bond.

  34. No party shall end after 10 p.m. on any evening.
